What this document is:

This is our agreement with you. It covers what you can expect from us, what we expect from you, and what happens if things go wrong. We've tried to write it in plain English where possible. The capitalized sections (like "Disclaimer of Warranties") are legally required to be prominent—they're not us yelling at you.

Welcome to mydoula.page. These Terms of Service ("Terms") govern your access to and use of our platform. By creating an account or using our service, you agree to be bound by these Terms. If you do not agree, please do not use mydoula.page.

1. Description of Service

mydoula.page provides a platform for doulas to create and manage professional web pages. Our service includes:

  • Personalized profile pages hosted on a subdomain (yourname.mydoula.page)
  • Contact forms that relay inquiries from prospective clients
  • Group and collective pages for doula organizations
  • Customization options for colors, themes, and content

What we are not: mydoula.page is a website hosting platform. We do not provide doula services, medical advice, credential verification, booking or scheduling services, or payment processing between doulas and their clients.

2. Account Registration

To use mydoula.page, you must:

  • Be at least 18 years of age
  • Provide a valid email address
  • Provide accurate information about yourself and your services
  • Maintain the security of your account credentials

You are responsible for all activity that occurs under your account. Please notify us immediately at legal@mydoula.page if you suspect unauthorized access to your account.

3. Trial Period

New accounts receive a 30-day free trial. During the trial, you have full access to all features. No payment information is required to start your trial. We will notify you before your trial ends. If you do not add a payment method before the trial expires, your profile will be taken offline, but we'll keep your data for 30 days in case you change your mind.

4. Payments and Subscriptions

  • Billing: Subscriptions are billed monthly or annually, at your choice. All payments are processed securely by Stripe.
  • Auto-renewal: Subscriptions automatically renew at the end of each billing period unless you cancel.
  • Cancellation: You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of your current billing period.
  • Refunds: We handle refund requests individually. If something isn't right, reach out and we'll work with you.
  • Price changes: We will provide at least 30 days' notice before any price increases. Price increases will take effect at the start of your next billing period after the notice period.

5. Your Content

You retain ownership of the content you post on mydoula.page, including your bio, photos, service descriptions, and testimonials. By posting content, you grant us a non-exclusive, worldwide, royalty-free license to host, display, and distribute your content solely for the purpose of operating the service.

This license ends when you delete your content or close your account, except for content that has been shared by others or cached by search engines.

6. Acceptable Use

You agree not to use mydoula.page to:

  • Post false, misleading, or fraudulent information
  • Misrepresent your qualifications, certifications, or experience
  • Impersonate another person or organization
  • Post content that is illegal, harmful, threatening, abusive, harassing, defamatory, or discriminatory
  • Violate any applicable laws or regulations
  • Infringe on the intellectual property rights of others
  • Interfere with the operation of the service or other users' access
  • Attempt to gain unauthorized access to our systems
  • Use automated tools to scrape or access the service without permission
  • Resell or redistribute the service without authorization

7. Credentials and Verification

A note for prospective clients

mydoula.page does not verify the credentials, certifications, training, or experience of doulas who use our platform. Doulas describe their own qualifications, and we don't vet the information they provide. The presence of a doula on mydoula.page does not mean we've checked their background or endorse their services. If you're looking to hire a doula, please ask them directly about their qualifications.

Note: The next two sections are in capitals because the law requires us to make them prominent. Please read them.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE. WE DO NOT WARRANT THE ACCURACY, COMPLETENESS, OR USEFULNESS OF ANY INFORMATION PROVIDED BY DOULAS ON THE PLATFORM.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MYDOULA.PAGE AND ITS OWNERS, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE, REGARDLESS OF WHETHER WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

10. Indemnification

In plain English: if someone sues us because of something you did (like posting content that wasn't yours to post, or a dispute with a client), you agree to cover our costs.

You agree to indemnify, defend, and hold harmless Honey Badger Digital LLC (doing business as mydoula.page), its officers, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from: (a) your use of the service; (b) your content; (c) your violation of these Terms; (d) your violation of any third-party rights; or (e) any dispute between you and a client or other third party related to your doula services.

11. Termination

  • By you: You may close your account at any time through your account settings or by contacting us.
  • By us: We may suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or for any other reason at our discretion. We will provide notice when reasonably possible.
  • Effect of termination: Upon termination, your profile will be taken offline. We will retain your data for 30 days in case you change your mind, after which it will be permanently deleted.

12. Intellectual Property

The mydoula.page service, including its design, features, code, and branding, is owned by us and protected by intellectual property laws. These Terms do not grant you any right to use our trademarks, logos, or branding. You may not copy, modify, distribute, or create derivative works based on our service without our written permission.

13. Copyright and DMCA

We respect the intellectual property rights of others. If you believe that content on mydoula.page infringes your copyright, please send a DMCA takedown notice to legal@mydoula.page with the following information:

  • Identification of the copyrighted work you claim has been infringed
  • Identification of the material you claim is infringing, with enough detail for us to locate it
  • Your contact information (name, address, phone number, email)
  • A statement that you have a good faith belief that the use is not authorized by the copyright owner
  • A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on their behalf
  • Your physical or electronic signature

We aim to respond to valid requests within 48 hours. If you're a rights holder with concerns, please reach out before sending legal threats—we're nice and will work with you.

14. Dispute Resolution

If you have a dispute with us, please email us first at legal@mydoula.page. We want to resolve problems directly when we can. If we can't work it out within 30 days, either of us can take it to court. Any legal action must be brought in the courts of the Commonwealth of Pennsylvania, and you consent to the jurisdiction of such courts.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania, without regard to its conflict of law provisions.

16. Changes to Terms

We may modify these Terms from time to time. If we make material changes, we will notify you by email or by posting a prominent notice on our service at least 30 days before the changes take effect. Your continued use of the service after changes take effect constitutes acceptance of the modified Terms. If you don't agree with the changes, you can close your account before they take effect.

17. General Provisions

Legal housekeeping

  • Entire agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and mydoula.page.
  • Severability: If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect.
  • Waiver: Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.
  • Assignment: You may not assign or transfer these Terms without our consent. We may assign these Terms without restriction.
  • Notices: We may provide notices to you by email or by posting on the service. You may provide notices to us at legal@mydoula.page.
